Changes to TOS - how does this apply to servers

I have just read the email and FAQs regarding the use of Docker in a commercial environment.

I understand that it is now based on the number of people using the software, but it is unclear how this applies for using docker only on server or hosted environments.

For example if you use a docker image only on a linux server to host a MySQL database, or use Azure hosted containers, ie no actual developer is using the desktop software. How is this licensed under the new terms and conditions.

Any clarification would be very gratefully received.

The changes is only for Docker Desktop, if you have docker running on a server, you’re not affected
